Terms and Conditions
These Terms and Conditions form a legally binding agreement between individual entrepreneur Yulia Bokuchava (hereinafter referred to as “Bokuchava Art”) and any individual or entity (hereinafter referred to as the “User”) who purchases goods or services from Bokuchava Art or accesses the website bokuchava.art. By using this website, the User acknowledges and agrees to these Terms and Conditions.
Article 1: Website and Services
1.1. The website bokuchava.art is the official platform of the Bokuchava Art online store, where Users can purchase and pay for artworks both online and offline.
1.2. By using the services of Bokuchava Art or accessing the website, Users consent to receiving SMS and/or email notifications about order statuses, as well as updates and promotional messages related to Bokuchava Art.
Article 2: Privacy Policy
2.1. Bokuchava Art is committed to protecting the personal data provided by Users, in accordance with these Terms and applicable laws.
2.2. Bokuchava Art may process information or documents provided by Users in compliance with Georgian legislation. This includes data submitted through the website or via other communication channels (e.g., phone, social media, email, WhatsApp, Viber, Telegram).
2.3. Bokuchava Art is authorized to process Users’ personal data under subsection “d” of paragraph 2 of the Georgian Law on Personal Data Protection.
2.4. Purposes for processing personal data include:
• 2.4.1. Notifying Users about their order status.
• 2.4.2. Providing information about Bokuchava Art’s offers and updates.
• 2.4.3. Conducting direct marketing and promotional campaigns.
• 2.4.4. Generating statistical data.
• 2.4.5. Improving Bokuchava Art’s products, services, and website.
• 2.4.6. Managing payments via the website.
• 2.4.7. Any other lawful purposes related to the sale of artworks.
2.5. Bokuchava Art may share personal data when required by law, during legal proceedings to protect its interests, or as part of a business reorganization, merger, or sale.
Article 3: Intellectual Property
3.1. The website bokuchava.art, its software, product images, descriptions, services, the name Bokuchava Art, its logo, and all text materials are the exclusive property of Bokuchava Art and are protected under Georgian law.
3.2. Users may use the materials mentioned in section 3.1 for personal purposes only.
3.3. Users are prohibited from altering, reproducing, translating, selling, or using these materials for commercial purposes. Users also may not remove or modify brand names, logos, or any identifying marks.
Article 4: Order Placement and Refund Policy
4.1. Users are responsible for ensuring the accuracy of order details, including their contact information, the recipient’s contact details, and the delivery address.
4.2. Bokuchava Art reserves the right to contact the recipient to confirm the delivery address. Upon the User’s request, Bokuchava Art will not disclose the User’s personal information, except as required by law.
4.3. Due to the nature of artworks, payments are non-refundable once a purchased artwork has been framed or the service has been fully performed.
4.4. If an order cancellation is agreed upon before the artwork is framed, Bokuchava Art will refund the User within seven (7) business days from the date of cancellation.
Article 5: Final Provisions
5.1. If any clause in these Terms is deemed invalid, it will not affect the validity of the remaining clauses.
5.2. The governing location for the fulfillment of these Terms is the registered legal address of Bokuchava Art.
